1. Agreement to Terms
By accessing or using the services of RXB Rexburg Concrete, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. We reserve the right to modify these terms at any time, and your continued use of our services after any changes constitutes acceptance of the new terms.
2. Services Provided
RXB Rexburg Concrete provides concrete installation, repair, and related services to residential and commercial customers in Rexburg, Idaho and surrounding areas. The specific scope of work for each project will be detailed in a written estimate or contract. We reserve the right to refuse service to anyone for any reason at any time.
3. Estimates and Pricing
We provide free estimates for our services. All estimates are valid for 30 days from the date of issuance. Pricing may be subject to change based on unforeseen site conditions, material costs, or changes to the scope of work. Any changes to pricing will be communicated to you in writing before proceeding with the work. Payment terms will be outlined in your contract and may include deposits, progress payments, and final payment upon completion.
4. Scheduling and Delays
We make every effort to complete projects on schedule. However, delays may occur due to weather conditions, material availability, unforeseen site conditions, or other factors beyond our control. We will communicate any delays as soon as possible and work to minimize their impact on your project. We are not liable for damages resulting from delays outside our control.
5. Site Access and Preparation
You are responsible for providing clear access to the work area and ensuring that utilities are marked before we begin work. We recommend contacting your local utility company to mark underground lines. You are also responsible for removing or protecting any personal property in the work area. We are not responsible for damage to unmarked utilities or personal property left in the work area.
6. Warranty and Guarantees
We stand behind the quality of our work. Specific warranty terms will be outlined in your contract and vary depending on the type of service provided. Our warranty covers defects in workmanship but does not cover damage caused by improper use, lack of maintenance, ground settling, or acts of nature. To make a warranty claim, you must contact us in writing within the warranty period.
7. Limitation of Liability
Our liability for any damages arising from our services is limited to the amount paid for those services. We are not liable for indirect, incidental, or consequential damages. This limitation applies to the fullest extent permitted by law. Some states do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages, so these limitations may not apply to you.
8. Permits and Approvals
Unless otherwise specified in your contract, you are responsible for obtaining any necessary permits or approvals from local authorities. We can assist with this process if requested. All work will be performed in compliance with applicable building codes and regulations.
9. Cancellation and Changes
You may cancel your project at any time by providing written notice. If you cancel after work has begun, you will be responsible for payment for work completed and materials purchased. Changes to the scope of work must be approved in writing and may result in additional charges. We reserve the right to cancel a project if site conditions are unsafe or if you breach these terms.
10. Dispute Resolution
If a dispute arises regarding our services, we encourage you to contact us directly to resolve the issue. If we cannot reach a resolution, you agree to submit the dispute to binding arbitration in accordance with the rules of the American Arbitration Association. This agreement to arbitrate does not apply to any claim for personal injury or property damage.
11. Governing Law
These Terms of Service are governed by the laws of the State of Idaho. Any legal action related to our services must be brought in the courts of Madison County, Idaho.
